Intellectual property

Hôtel Marguerite is the only party authorized (directly or through licenses or authorizations) to use the elements making up the Site, the domain names, trademarks, models, etc., as well as the images and editorial content reproduced therein.

The use of all or part of the Site, in particular by downloading, reproduction, transmission, representation or broadcasting for purposes other than consultation and use of the Site on a personal and private basis by the Internet user for non-commercial purposes, is strictly forbidden. Violation of these provisions exposes its author to the penalties provided for both by the French Intellectual Property Code, in particular for infringement of copyright and trademark rights, and by the French Civil Code in terms of civil liability.

The creation of any hypertext link to any of the web pages or elements making up the Site is prohibited without the prior written authorization of Hôtel Marguerite, which authorization may be revoked at any time. Any content, Internet site or other having a hypertext link directing to the Site or to any of the elements that make it up are not under the control of Hôtelière FPPA and the latter consequently declines all responsibility (in particular, editorial) concerning access to these sites and their content.

 

Site availability


Hôtel Marguerite makes every effort to keep the Site permanently accessible, but is under no obligation to do so. Hôtel Marguerite may therefore interrupt access to the Site, in particular for maintenance or updating purposes, or for any other reason, in particular technical or editorial, without prior notice or information to Internet users, and Hôtel Marguerite shall not be held liable for the consequences of such interruptions, either to Internet users or to any third party.

Moreover, Hôtel Marguerite shall not be held liable if Internet users are unable to access all or part of the Site due to any technical fault or problem, including but not limited to :

  • human or electrical error,

Consumer mediator


In accordance with article L. 612-1 of the French Consumer Code, the consumer, subject to article L.612.2 of the French Consumer Code, has the right to submit a request for amicable resolution by mediation, within a period of less than one year from the date of his or her written complaint to the professional. HOTEL VILLA MAILLOT has designated SAS Médiation Solution as a consumer mediation body, under membership number 52489/VM/2402. To refer a matter to the mediator, the consumer must make his or her request:

Whatever means of referral is used, the request must contain :

  • The postal, telephone and electronic contact details of the claimant,
  • The name, address and Sas Médiation Solution registration number of the professional concerned,
  • A brief statement of the facts,
  • A copy of the prior complaint,
  • All documents required to investigate the claim (purchase order, invoice, proof of payment, etc.).
     

Opposition list to telephone canvassing

In accordance with article L.223-2 of the French Consumer Code, consumers who do not wish to be the subject of commercial canvassing by telephone can register free of charge on an opposition list to telephone canvassing.

Disputes


The present terms and conditions are governed by French law. Any disputes arising from the interpretation or execution of these terms and conditions shall be submitted to the exclusive jurisdiction of the courts having jurisdiction over the company's registered office. The reference language for the settlement of any disputes shall be French.

Cancellation or modification of a reservation for a service


For Accommodation Services (reservation of rooms in a Hotel or other types of accommodation), the Customer is reminded that he/she does not have the right of withdrawal provided for in article L. 221-18 of the French Consumer Code, and this in accordance with article L. 221-28 paragraph 12 of the French Consumer Code, which excludes this right for contracts relating to the provision of accommodation services which must be supplied on a specific date or for a specific period.

For each Service reservation, the cancellation policy specifies how the reservation may be cancelled and/or modified.

Service reservations may be modified by contacting the establishment, whose telephone and other contact details are specified on the reservation confirmation sent by e-mail.

The customer must leave the room before the time indicated by the establishment. Failure to do so will result in the invoicing of an additional night's stay.


Right of withdrawal


Pursuant to Article L221-28 of the French Consumer Code, consumers do not have a right of withdrawal.

 

Responsibility


Hôtel Marguerite makes every effort to ensure that the information provided on the Site is accurate and up-to-date, and reserves the right to modify the content of the Site at any time without notice.

However, Hôtel Marguerite cannot guarantee the accuracy, precision or completeness of the information made available on the Site, which information constitutes neither a guarantee nor a commitment on the part of Hôtel Marguerite with regard to the Internet user. In particular, Hôtel Marguerite shall not be held liable for :

  • any imprecision, inaccuracy or omission in the said information;
  • any damage resulting from computer intrusion by a third party leading to modification of the said information;
  • and, more generally, any damage, direct or indirect, whatever the cause, origin, nature or consequences, linked to access (or the inability to access the Site), to the content, to use of the Site and/or to the credit given to any information coming from the latter.

 

Terms and Conditions - Hôtel Marguerite
 

1. Purpose

These terms and conditions govern the contractual relationship between Hôtel Marguerite and its guests in the context of room reservations and hotel stays.

 

2. Reservation

 

A reservation is considered firm and final once a written confirmation has been sent by the hotel (by email or via a booking platform) and, if applicable, after a pre-authorization or deposit has been secured. Upon receipt of this confirmation, both the hotel and the guest are contractually bound.

Pre-authorization corresponds to the amount of the first night of the stay. It is a temporarily blocked amount, not charged, and released at departure. However, it may be charged in case of payment failure or damage to the room.

 

3. Rates

 

All rates are in euros, inclusive of taxes (VAT), but exclude the local tourist tax.
The tourist tax is charged in addition, according to current regulations.
Prices may vary depending on the season, demand, or special offers. The rate confirmed at the time of booking is guaranteed.

 

4. Payment Terms

 

Payment for the stay can be made:

  • upon arrival or departure, depending on the selected rate;
  • by credit card, bank transfer, or cash (within legal limits);
  • immediately and in full for non-refundable bookings.
  • For bookings requiring a deposit, conditions will be specified during the reservation process.

 

5. Cancellation / Modification

 

  • Standard rate: Free cancellation up to 48 hours before the arrival date. After this period, or in case of no-show, the first night may be charged to the credit card provided at the time of booking, in accordance with the authorization given.
  • Non-refundable rate: No refunds or modifications are allowed in case of cancellation or no-show.
  • Group bookings: Conditions are defined on a case-by-case basis and specified in a personalized quote.
  • All cancellation or modification requests must be made in writing (via email or booking platform).

 

6. Check-in / Check-out
 

  • Check-in from 3:00 PM
  • Check-out by 12:00 PM
  • Late check-outs may incur additional charges, unless previously agreed with reception.

 

7. Hotel Stay

 

Guests are expected to respect the premises, the peaceful environment, and the comfort of other guests.
All rooms are non-smoking. A cleaning fee may apply in the event of non-compliance.
Pets are not allowed in the hotel. If a pet is brought in without authorization, a cleaning fee of €15 per night may be charged as compensation.

 

8. Liability

 

The hotel accepts no liability for loss, theft, or damage to personal belongings unless a proven fault is attributable to the hotel.
Safes are available free of charge in all rooms.
Guests are liable for any damage caused in private or shared areas.

 

9. Force Majeure

 

The hotel shall not be held responsible for the total or partial non-performance of its obligations in the event of unforeseen, irresistible, and external circumstances (e.g. natural disaster, pandemic, transport strikes, etc.).

 

10. Personal Data

 

Personal data is collected solely for managing reservations and the guest relationship.
In accordance with the General Data Protection Regulation (GDPR), guests have the right to access, rectify, delete, oppose, or transfer their personal data.

Guests may also file a complaint with the French Data Protection Authority (CNIL).
Data is retained only for the duration strictly necessary for managing the business relationship.

 

11. Disputes

 

In the event of a dispute, the hotel will seek an amicable solution. Failing this, the courts of Paris shall have exclusive jurisdiction.

 

12. Acceptance of Terms

 

Any reservation implies full acceptance of these terms and conditions.
For online bookings, the act of clicking to confirm constitutes an electronic signature as defined by Article 1366 of the French Civil Code.
